Terms of Use

The agreement that covers using ChatterFork, including what happens with the content you post.

Last updated October 28, 2026

The short versionThe full Terms below is what governs.

These Terms of Use ("Terms") are an agreement between ChatterFork, Inc., a Delaware corporation ("ChatterFork," "we," "us" or "our") and people or businesses accessing ChatterFork.com, the ChatterFork mobile application, creator tools, restaurant pages and related services (collectively, the "Platform"). By creating an account, selecting an acceptance control, or using the Platform where these Terms are presented, you agree to them. If you do not agree, do not use the Platform. Our Privacy Policy at https://chatterfork.com/privacycenter/policy/ describes our personal information practices. Additional program terms may apply to paid missions, subscriptions and creator programs.

1Eligibility, parental consent and accounts

Users age 18 or older may register for an account, subject to these Terms. Users 13 through 17 may use the Platform only with prior permission from a parent or legal guardian who has reviewed and agreed to these Terms on their behalf and who accepts responsibility for supervising the minor's use to the extent allowed by law. If you are 13 through 17, you represent that you have obtained that permission. A parent or guardian providing consent represents that they have authority to do so. ChatterFork may request confirmation of consent, restrict features for minors or suspend an account when required protections are not in place.

Children under 13 may not create a ChatterFork account or submit content unless and until ChatterFork explicitly offers an age-appropriate process that obtains verifiable parental consent and complies with applicable children's privacy requirements. Ordinary approval from an adult is not sufficient for this category. ChatterFork does not presently represent that such a process is available. Where local law requires additional safeguards for older minors, those requirements also apply. Only users 18 or older may participate in creator payouts or paid missions unless ChatterFork expressly establishes an approved, legally compliant minor participation program.

You must provide accurate account information, safeguard credentials and tell us promptly if you suspect unauthorized access. You may not impersonate another person or falsely claim to represent a restaurant. We may verify restaurant representatives and payment recipients.

2How ChatterFork works

ChatterFork helps people discover individual dishes and restaurants, share food experiences, follow creators or friends, and receive recommendations informed by personal taste signals. The Platform may organize posts around a shared dish record, compare taste preferences, display restaurant and creator pages, and offer commercial tools. Features may change or be released in stages. Planned functionality is not a promise of availability. ChatterFork generally does not prepare, sell or serve the food listed on the Platform and does not operate independently listed restaurants.

3User content and rights

"User Content" means original photos, videos, audio, captions, reviews, ratings, comments and other material you upload or submit. You keep ownership of your original User Content. Uploading does not transfer your copyright to ChatterFork. You represent that you own the material or have the permissions necessary for the uses you authorize, including permissions for embedded music, trademarks, and identifiable people where required. You must not claim another creator's material as your own or upload material you cannot license.

A restaurant's appearance in a video, or a person's posting about a dish, does not itself transfer ownership of that video to the restaurant. User ownership and ChatterFork's licenses are different rights, as explained below.

4ChatterFork's license to use published content

When you publish User Content on ChatterFork, you give ChatterFork a worldwide, nonexclusive, royalty-free (except where a separate paid program expressly provides compensation), transferable and sublicensable license to host, store, reproduce, display, distribute, communicate, index, format, crop, caption, transcode, translate, excerpt and otherwise adapt that content for the purposes described in this section. This license permits technical service providers to act on ChatterFork's behalf and permits ChatterFork to operate, develop and promote its services, subject to applicable law, the Privacy Policy and the safeguards below.

A. Discovery and restaurant pages

ChatterFork may associate your public post with dishes, menus, restaurants, places, profiles and topics. It may display the post, or approved excerpts and thumbnails, in organic feeds, search results, persistent dish pages, and on a restaurant's ChatterFork page, including one claimed or managed by that restaurant.

Posts may appear on restaurant pages through ChatterFork's ordinary discovery and display functionality, including pages managed by participating restaurants. Such display does not authorize a restaurant to independently select, feature, reproduce, or promote creator media for its own commercial purposes.

B. Platform promotion and monetization

ChatterFork may operate, recommend, organize, and monetize its discovery feeds, dish pages, restaurant listings, and related Platform features.

Paid restaurant visibility does not automatically grant restaurants promotional rights to creator photographs, videos, or other original media. It also does not buy the right to rewrite a user's review, alter its rating, falsely imply endorsement or remove honest criticism. Commercial placement and paid relationships must be labeled when required.

Any restaurant-directed promotional use of creator media requires separate authorization from the applicable rights holder under an approved licensing arrangement.

C. Marketing by ChatterFork

ChatterFork may reproduce and promote eligible public posts and excerpts in ChatterFork-operated websites, app-store materials, email, organic social accounts and marketing communications to explain or advertise ChatterFork, its food discovery service, and dishes or restaurants available through it. Separate, affirmative permission will be obtained for use of an identifiable person's likeness or original content in a new off-Platform paid advertisement where that consent is required by law or by ChatterFork's applicable creator permission process. We will not deliberately present a negative review as a positive endorsement or remove context in a misleading way.

ChatterFork's general Platform marketing rights do not authorize it to grant restaurants independent promotional rights to creator media or to conduct restaurant-directed advertising using such media without the required authorization.

D. Creator content and restaurant promotional use

The appearance of creator content on a restaurant's ChatterFork page does not grant that restaurant ownership or independent commercial usage rights.

Restaurants may not download, reproduce, repost, modify, advertise with, or otherwise use creator media for their own promotional purposes, on or off ChatterFork, without authorization from the applicable rights holder.

ChatterFork may introduce a licensing program allowing restaurants with eligible paid subscriptions to request promotional rights to creator content. Any such use will require the creator's affirmative approval and agreement to the applicable compensation and licensing terms. Participation is voluntary. Creators may decline requests without affecting their original reviews or ordinary participation on ChatterFork.

Until such authorization is obtained, the restaurant receives no additional promotional rights through its ChatterFork subscription. ChatterFork may not promise rights that the original creator did not grant.

E. Privacy choices and deletion

This section applies to content you deliberately make public. Private messages, drafts and access-restricted content are not licensed for public commercial display merely because they pass through the Platform. When you delete a public post or close your account, ChatterFork will remove the original post from ChatterFork-controlled public displays under its deletion procedures and Privacy Policy. Some copies may remain temporarily in backups, caches, search indexes, security records, or lawfully completed publications. Existing third-party shares cannot always be recalled. A separately signed campaign license may describe a limited wind-down or retention period. ChatterFork will not rely on these Terms alone to continue new commercial publication of deleted original content indefinitely. Lawfully produced aggregated, deidentified or independent structured records may remain, as described below.

We may display your public username or account handle in connection with your post to provide attribution, and may use content metadata needed to identify the dish, restaurant and publication context. We do not claim a right to sell private personal information by granting these content rights. Rights involving minors remain subject to additional consent, legal limitations and available feature settings.

5Seed content and third-party material

ChatterFork may launch a new market using "Seed Content," which may include restaurant details, menu information, authorized creator posts, licensed images or videos, business-submitted materials and ChatterFork-produced content. Seed Content is not automatically User Content covered by the license above. Its use is governed by its owner, source agreement, express permission, applicable license or other valid legal basis.

Public availability on the Internet does not, by itself, authorize ChatterFork to copy, host, publish or commercially reuse third-party photographs, videos, captions or music. ChatterFork will seek to track source, owner, permitted channels, attribution requirements, commercial-use rights, expiration dates and removal requests for imported media. A restaurant's ability to feature content does not expand ChatterFork's underlying source license. ChatterFork may remove, replace or limit Seed Content if rights cannot be established.

6Dish records, data compilations and platform intelligence

ChatterFork may derive dish names, dish-to-restaurant associations, cuisine classifications, ingredient and flavor descriptions, location references, search tags, engagement statistics, taste signals and other structured information from licensed content and lawful data sources. Multiple posts may attach to the same persistent dish record. A dish or restaurant record can continue to exist when a contributing user deletes their post.

As between ChatterFork and its users, ChatterFork owns or holds the applicable rights in its original software, databases, organization, selection and arrangement of information, proprietary scoring models, classifications, generated metadata and independently created compilations, to the extent protected by law. This does not override anyone else's rights in their original expressive content, trademarks, personally identifiable information or underlying facts. ChatterFork may use lawfully created aggregate or deidentified metrics for search, research, product development and restaurant reporting, subject to the Privacy Policy.

7Taste profiles and recommendation limitations

ChatterFork may infer preferences using your ratings, flavor selections, reviews, search and viewing activity, saves, follows and other permitted signals. Recommendations are estimates, not promises that you will like a dish. Similar tastes do not mean identical preferences. Results may reflect availability, distance, content quality and transparent sponsored placements. ChatterFork will not represent that a paid promotional placement is an independent user review or secretly alter the text or rating of an authentic review to benefit an advertiser.

8Genuine reviews and material connections

Reviews must reflect actual experience and honest opinion. You may post a negative review. You may not fabricate a visit, claim to have consumed food you did not try, impersonate customers, buy fake engagement, post a copied review as an original experience, or manipulate ratings. Restaurants, employees, their immediate families and other insiders must disclose connections that could affect credibility. ChatterFork will not suppress an otherwise lawful, authentic negative review solely because a restaurant dislikes it or pays for Platform services.

If you received payment, a free meal, a discount, an invitation or another benefit for creating content, make a clear and conspicuous disclosure alongside the relevant endorsement. ChatterFork may add required labels, but creators and sponsoring businesses remain responsible for their own legal obligations. Payment or benefits must never be conditional, expressly or implicitly, on a positive or negative sentiment. Further details appear in the Community Guidelines, the Mission Fairness Standard and any applicable campaign rules.

9Paid missions and creator reward programs

ChatterFork may offer optional missions, restaurant content opportunities and later programs that compensate eligible creators for qualifying posts, approved usage, verified engagement or other disclosed criteria. Missions may be sponsored by a participating restaurant or by ChatterFork, and the same rules apply to both. No mission or virality payout exists merely because a post is popular, displayed on a restaurant's page, or monetized by ChatterFork unless the creator accepted an applicable published program offer.

Every paid mission or rewards program will specify, before participation: eligible users, participating restaurant or dish, permitted content and usage rights, deliverables, disclosure obligations, compensation method or formula, applicable measurement window, what counts as qualified engagement, eligibility and authenticity checks, payout timing, any caps, appeal process and conditions for withholding or reversing unearned rewards. Terms accepted for an active mission govern that mission, and material compensation changes will not be imposed retroactively on accepted completed work except where a lawful rule already provides for fraud correction or other stated adjustments.

Authenticity verification occurs before payout. ChatterFork may verify originality, genuine experience, authorized ownership, duplication, engagement authenticity, material-connection disclosures and compliance with objective mission requirements. It may request proportionate supporting evidence and allow redaction of unrelated personal information. Payment may be held for reasonable review of suspected fraud, duplicate claims, bought engagement, conflicts of interest or other stated violations, with notice and an opportunity to appeal when practicable. We will not deny an otherwise earned reward just because the review is negative, the creator criticizes a restaurant, or the sponsor dislikes the honest opinion. If a mission calls for deliverable verification, that review must not become a mechanism for conditioning payment on sentiment.

Engagement-based payments, if launched, will be calculated using qualified, authentic interactions rather than raw impressions, bot views, engagement exchanges or other manipulated activity, under formulas and safeguards published for the particular program. Anti-fraud adjustments and administrative reviews should be documented. ChatterFork may require identity, tax and payment verification and may restrict paid activities to adults. Separate campaign terms may grant specified restaurant off-Platform reuse rights only when the creator affirmatively agrees.

Ordinary discovery and display of a post do not automatically create a creator compensation obligation. Any additional restaurant-directed promotional use of creator media must be separately authorized and governed by the applicable licensing and compensation terms.

10Restaurant accounts, listings and promotions

Restaurants may appear on ChatterFork before they claim a page. Listing does not imply sponsorship, endorsement or an agreement. An account claiming a restaurant represents that it is authorized by the business. Restaurants must keep submitted menu and promotion information accurate, avoid misleading pricing or safety statements, and respect users' intellectual property and honest criticism. A restaurant may request factual corrections or report unlawful content but cannot demand removal of a genuine negative review in exchange for payment. Paid placements must be identified as sponsored or promoted where required.

11Community rules and enforcement

The Community Guidelines, available at https://chatterfork.com/privacycenter/guidelines/, explain content authenticity, safety, transparency, spam, commercial influence and reporting expectations. You may not harass people, publish personal information without authority, impersonate others, target minors with inappropriate content, infringe intellectual property, reverse engineer security controls, scrape the Platform without authorization or conduct fraud. ChatterFork may investigate, remove content, reduce distribution, suspend features, withhold disputed mission payouts for documented review, or terminate accounts as appropriate. Users may challenge an enforcement decision by emailing info@chatterfork.com. We do not promise to review every post before publication.

12Minors, creator programs and safeguarding

Minors with authorized accounts must not provide sensitive financial information or accept paid missions without a separately approved compliant process. ChatterFork may restrict public messaging, location-sharing, recommendations, promotional targeting, public visibility and other features for minor accounts. Parents and guardians should monitor the minor's sharing of images, precise locations, personal details and interactions with strangers. If we learn an account lacks required parental consent, we may limit or close it and handle associated information as described in the Privacy Policy.

13Food, health and third-party information

Food preferences and recommendations are not medical or nutritional advice. Menus, opening hours, prices, ingredients, dietary labels and allergen descriptions may be provided by restaurants or third parties and may be incorrect or change. Users with allergies or other health concerns should confirm ingredients, cross-contamination risks and preparation details directly with the restaurant. ChatterFork does not guarantee a meal's safety, availability or quality and does not operate independent restaurants. Links, ordering, reservations and payment providers may have their own terms.

14Intellectual property and Platform access

ChatterFork retains its rights in its brand, logo, software, interface, discovery technology, models and proprietary materials, excluding user-owned or third-party content. You receive a personal, limited, revocable, nonexclusive and nontransferable right to use the Platform in accordance with these Terms. No source code, bulk copying, database extraction, scraping, model extraction, resale or unauthorized commercialization is permitted except as required by law or with written permission. You retain all mandatory legal rights.

15Payments and subscriptions

Creating a free consumer account does not enroll you in a paid subscription. If ChatterFork later offers paid restaurant, creator or other services, pricing, renewals, cancellation terms, payment processor arrangements, and any legally required consent will be disclosed at purchase. Separate commercial agreements control where they specifically conflict with these Terms. In connection with creator earnings, users may need to provide payment or tax information through approved processors. Taxes remain the recipient's responsibility except where law requires ChatterFork to collect, withhold or report them.

16Privacy, data rights and security

Our Privacy Policy at https://chatterfork.com/privacycenter/policy/ governs personal information processing and includes information about public posts, deletion, parental and minor privacy, retention, rights and choices. In particular, the current policy states that ChatterFork does not sell personal information for money and addresses legal definitions of sale, sharing and targeted advertising. If advertising, creator payouts or reuse practices materially change personal-data processing, ChatterFork will update notices and provide required choices before implementation. Contact privacy@chatterfork.com for privacy questions.

17Copyright complaints and DMCA

Rights holders may report suspected infringement to ChatterFork's designated copyright agent. Notices should include identification of the copyrighted work, the material and its URL or sufficient location information, contact information, the required good-faith and accuracy statements and a signature. ChatterFork may remove or disable access to reported material, permit legally qualifying counter notices and terminate repeat infringers in appropriate circumstances. The designated agent's contact information will be posted publicly and registered with the U.S. Copyright Office before ChatterFork relies on applicable statutory safe harbors.

18Deletion, suspension and termination

You may request account deletion as described in the Privacy Policy, including through privacy@chatterfork.com. ChatterFork may restrict or terminate an account for material violations, fraud, intellectual property infringement, serious safety threats or legal obligations. Prior earned payments and lawful payment disputes will be handled under the specific program terms and applicable law. Sections reasonably intended to survive, including rights to independent database records, accrued payment duties, legal defenses and applicable dispute provisions, survive to the extent lawful. Removal of an account does not authorize an unlimited right to continue displaying original content contrary to Section 4 or the Privacy Policy.

19No warranties and limitations of liability

To the extent permitted by law, the Platform is provided on an "as is" and "as available" basis without guarantees of uninterrupted service, perfect recommendations, current restaurant information or specific outcomes. ChatterFork disclaims implied warranties only to the extent legally permitted. To the extent lawful, ChatterFork and its personnel will not be liable for indirect, consequential, special or punitive damages arising from the Platform. ChatterFork's total liability for a claim will not exceed the greater of US $100 or the amount paid directly by the claimant to ChatterFork for the relevant service during the preceding 12 months. These limitations do not exclude liability that applicable law prohibits excluding, including where legally required for fraud, willful misconduct or consumer protections.

20Indemnity

To the extent permitted by law, you agree to defend and indemnify ChatterFork against third-party claims and reasonable costs caused by your unlawful content, infringement of another's intellectual property rights, fraud or material breach of these Terms. This obligation does not apply to the extent a claim results from ChatterFork's own wrongdoing or another circumstance that law prohibits shifting to you.

21Changes to Terms and services

ChatterFork may update these Terms as operations, laws and features change. Material changes affecting rights, commercial content uses or privacy will be communicated and accepted where required. We will identify the updated effective date. We will not retroactively reduce earned creator rewards for completed valid missions merely by posting revised general Terms. If you do not accept updated Terms, discontinue use and exercise available account deletion rights.

22Governing law and disputes

These Terms are governed by the law of the State of Texas, subject to mandatory consumer laws. Before filing a lawsuit, the parties should attempt informal resolution by notifying legal@chatterfork.com and allowing 30 days to respond, except where urgent relief or another legally protected process is appropriate. Unresolved claims may be brought in courts of competent jurisdiction in Harris County, Texas, subject to applicable venue and consumer protections. These Terms do not impose mandatory arbitration or a class-action waiver.

23General terms

If a provision is unenforceable, the remaining Terms remain effective to the extent lawful. A failure to enforce a provision is not a waiver. ChatterFork may assign these Terms as part of a lawful corporate transaction. These Terms, the Privacy Policy where applicable and accepted supplementary program terms form the relevant agreement for their subject matter. Neither party loses nonwaivable legal rights.
